Proposed NDIS Reforms: What Providers Need to Know

Under proposed changes to the National Disability Insurance Scheme (NDIS), NDIS providers could face harsh new penalties and criminal offences if they’re found to be in breach of their registration conditions.

Upcoming changes to penalties and criminal offences

The Australian government has introduced the “Getting it Back on Track” bill as part of new NDIS reforms to improve protections and service quality for NDIS participants.

Under the proposed legislation, the NDIS Quality and Safeguards Commission will receive enhanced authority to enforce higher standards in service quality and safety. Penalties for providers will increase dramatically, with maximum fines jumping from $400,000 to $15 million if a participant is harmed under a provider’s care. This brings penalties for injuring a participant in line with the maximum penalty for harming a worker.

For the first time, the Commission will have the authority to refer providers for criminal prosecution for serious non-compliance with NDIS conditions.

Banning orders will now extend to individuals in auditing and consulting roles within the NDIS, not just providers, to prevent unethical practices across all areas of the Scheme.

The proposed legislation includes measures to:

  • Implement stricter regulatory standards with tougher penalties and criminal charges for non-compliance.
  • Enhance information-gathering powers to improve oversight and ensure compliance among NDIS providers and associated parties.
  • Broaden the scope of banning orders to encompass individuals involved in key areas of the NDIS, including auditing and consulting services.

Ultimately, these new measures are intended to ensure NDIS providers operate ethically while also providing reassurance to participants that they’re receiving reliable, high-quality services.
